Delaware Alimony Laws
In Delaware, spousal support becomes relevant once a married couple physically separate from one another. It can continue indefinitely until someone files a divorce petition with the Court. Once a divorce is filed, spousal support is converted to alimony. Spousal support is non-taxable “free” money. Alimony is taxable income to the recipient and tax deductible to the obligor. Delaware law dictates how much alimony is paid based on several factors. The primary factors are the annual, taxable incomes and “reasonable” monthly expenses of both parties.
The longer a marriage lasts the longer your alimony entitlement/obligation may be. If you were married in excess of 20 years, you may be entitled to, or subject to, lifetime alimony payments. For marriages less than 20 years, your alimony entitlement/ obligation will be for no more than one-half the length of the marriage absent a written agreement to the contrary. Delaware law also allows for a modification or termination of alimony under certain circumstances.
Oftentimes, there are children born of the marriage. If child support is being paid/received the court needs to know this and take this into consideration so that a fair spousal support/alimony award can be set. This prevents you from either receiving double payments or making double payments.
